Abstract

In historiography, the dominant liberal paradigm about the property has involved a conception of property as an "idea" that defines the relations of people with things. This ahistorical way of conceiving the property, defined here as "legalistic" or "statist", has a decisive influence on the interpretation of historical facts and social, economic, political and cultural phenomena. This conference expresses the need for a change of paradigm, to recover the "historicity" of the property. It also presents a possible research program for the future, in order to progress in an approach that claims the property rights as "work", as "social construction".
